Форумчане, юристы и знающие люди, нужен ваш совет.
Брат проходит свидетелем по делу ч.1 ст 122 (умышленное нанесение телесных повреждений средней тяжести). Пришла повестка на конкретное число, но брат в это время собирается отдыхать по путёвке с семьёй. С потерпевшим он в родственных отношениях и не знает, как поступить.
Подскажите, как ему правильно поступить?

Чего он хочет избежать в случае неявки - официального наказания или обиды родственника?

Заблаговременно письменно уведомить суд о своих планах. Тем более что путевка- это подтверждение. Родственникам тоже пояснить, что обратился с просьбой в суд о переносе времени своего присутствия. Так будет порядочно и в соответствии.

+1 к уведомить суд. Или изложить все письменно, что видел. ИМХО, суд не один день будет проходить, еще успеет очно рассказать увиденное.
