Так ведь и по существующим законам если пешеход нарушил правила дорожного движения и это повлекло смерть человека - сядет как миленький. Если это было сделано умышленно, то рассматривается как умышленное убийство. А если из-за этого улетел например в пропасть автобус, то сесть можно на максимальный срок.
